Applicability of the General Terms and Conditions (GTC)
All deliveries, services, and offers of SNIPES SE (hereinafter: “SNIPES”) are made exclusively on the basis of these terms and conditions, unless the parties expressly agree otherwise in writing. The following General Terms and Conditions always apply in the version valid at the time of the order.
Contractual terms set by the customer or a third party shall not become part of the contract, even if SNIPES does not expressly object to them.
If SNIPES identifies security-related risks or vulnerabilities in the use of the online shop or associated user accounts, SNIPES reserves the right to take measures to prevent potential risks. This may lead to a temporary restriction of the usability of the online shop and/or user accounts.

Conclusion of Contract
You submit a binding offer to SNIPES SE when you complete the online ordering process by entering the requested information and click the “Buy Now” button in step 4. After sending your order, we will send you an email confirming receipt of your order and detailing it (order confirmation). This order confirmation does not constitute acceptance of your offer but merely informs you that your order has been received.
A purchase contract is only concluded when we dispatch the ordered product to you. If you do not receive a shipping notification within 7 days of placing your order, you are no longer bound by your offer. If the ordered goods are not available, we reserve the right not to deliver. In this case, we will inform you immediately and refund any payments already received. You can track the status of your order in your account under “My Orders.”
Exceptions – a purchase contract is concluded:
with prepayment at the time of the payment request,
with Giropay, PayPal, Paydirekt, and Sofortüberweisung.de when the payment instruction is confirmed to us,
with credit card payment upon completion of the order process.

Prices & Shipping
The prices refer to the items published on the internet subject to the respective description. All prices are final prices, i.e. they include the legally valid VAT. The applicable price is the one valid at the time of the order. Delivered goods remain the property of SNIPES SE until full payment has been received.
Shipping costs are charged additionally only for orders below €59.99. From an order value of €60, shipping is free of charge.
You can also choose to have the ordered goods delivered to a SNIPES store of your choice for collection (in-store pickup). In this case, you will be notified by a separate email as soon as the goods are ready for collection. You then have the option to pick up the goods within 14 days of receiving the collection notification.

Default in Payment
If the customer is in default of payment of due claims, SNIPES is entitled to charge the statutory default interest. The right to assert a higher damage caused by delay is not excluded.
Objections & Offsetting
Objections to the amount of an invoice from SNIPES must be raised in writing within 14 days of receipt of the invoice enclosed with the goods. Statutory claims that can be asserted even after the deadline remain unaffected.
Liability & Warranty
Warranty and liability are governed by statutory provisions, in particular §§ 434 et seq. BGB, unless otherwise specified below.
SNIPES is liable for intent and gross negligence. For slight negligence, SNIPES is only liable in case of a breach of a material contractual obligation (cardinal duty) and in cases of damages resulting from injury to life, body, or health. The exclusion of liability does not apply to guaranteed product characteristics.
In cases that do not concern injury to life, body, or health or guaranteed product characteristics, liability for slight negligence is limited in amount to the foreseeable damage typical for this type of contract.
The provisions of the Product Liability Act remain unaffected. Complaints

We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

Contract amendments and side agreements must be in text form to be effective. The necessity of text form also applies to the waiver of the requirement of text form.

Right of Withdrawal (Consumer Cancellation Policy)
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you (who is not the carrier) took possession of the goods.
To exercise your right of withdrawal, you must inform us (SNIPES SE, Schanzenstr. 41, 51063 Cologne, Germany, Tel: +49 (0)221 977 79 030, Email: [email protected]) by means of a clear statement (e.g., a letter sent by post, fax, or email) of your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.
To comply with the withdrawal period, it is sufficient that you send the notification of exercising the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw from this contract, we shall refund all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal.
For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged fees for this repayment.
We may withhold repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us immediately and in any event no later than fourteen days from the day on which you notified us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You shall bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.
Exclusion of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the delivery of goods:
that are not prefabricated and whose production requires an individual selection or decision by the consumer, or which are clearly tailored to the personal needs of the consumer
that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery
if these were inseparably mixed with other goods after delivery due to their nature
Voluntary Return Right up to 30 Days after Receipt of Goods
In addition to the statutory right of withdrawal, SNIPES voluntarily grants you a 30-day return right.
This does not limit your statutory rights.
SNIPES Raffle
Acceptance of Terms of Use
By participating in a raffle sign-up, you accept and agree to the following general terms and conditions (the “SNIPES Raffle Sign-Up Terms”).
Drawing of Purchase Rights
As part of the raffle (lottery), the right to purchase the selected product (the “Prize”) will be raffled. Winners will be given the opportunity to purchase the Prize within a specified time window.
The Prize is subject to availability (including the availability of sizes, styles, and colors). The Prize cannot be exchanged for cash and is non-transferable. The Prize is subject to the winner’s confirmation (i.e., SNIPES SE must be able to contact the winner and confirm eligibility to participate).
SNIPES SE is not responsible for delays, cancellations, or rescheduling of the Prize. If part of the Prize is not available or not fully redeemed within the communicated time window (for any reason), SNIPES SE is not obliged to provide an alternative prize; unclaimed products will be re-raffled.
Registration for the Raffle
You may only register for a raffle through the SNIPES App. A snipes.com account is also required for registration, which you can create directly in the SNIPES App.
In the app, you will find products marked as raffle products. These products can only be purchased by winners after the right to purchase has been raffled.
Only one registration per person is permitted. All entries must be submitted and received before the end of the participation period communicated in the app. Standard time and data charges from your mobile provider may apply. All entries are subject to verification. Proof of dispatch is not proof of receipt.
Participation of Minors
You must be at least 16 years old or have the consent of your parents or legal guardians in order to participate in raffle sign-ups. By registering, you confirm that you are of legal age or, if you are a minor, that your parents or guardians consent to your participation.
We may request proof of such consent at any time. Parents who provide consent are solely responsible for their child’s conduct under the law and are liable for any misconduct and resulting damages.
Selection of Winners
Winners are determined using a random generator and allocated according to the number of products available. No correspondence will be entered into regarding the selection of winners (except with the winners themselves).
Winners will be notified via email and push notification, and they must complete the order process including payment within the communicated time frame in order to purchase the product.
SNIPES SE reserves the right to re-check winners even after notification and to exclude them from the prize in case of a violation of these Terms.
Winners may only purchase the size indicated at the time of registration.
The product cannot be purchased in combination with promotions or discounts.
If payment is canceled during the ordering process, the prize cannot be guaranteed.
Unclaimed products will be released for general sale, and the original winner forfeits the right to purchase the product.
General Rules
SNIPES SE reserves the right to amend these SNIPES Raffle Terms at any time and to discontinue, modify, or suspend exclusive access or the Prize at any time.
SNIPES SE may, at its sole discretion, exclude or refuse participation to any person who, in the opinion of SNIPES SE: (i) has attempted to unlawfully influence the registration process or interfered with the lawful conduct of the raffle in any way; (ii) has engaged in behavior that disturbs, abuses, threatens, or harasses another participant or representatives of SNIPES SE; or (iii) has attempted, in whole or in part, or intends to attempt the foregoing.
The use of agents or automated devices, programs, or methods to submit entries is prohibited. SNIPES SE may, at its discretion, exclude participants who, in its opinion, have submitted an entry through an agent or automated device, program, or method.

By registering for the raffle, you agree to receive regular notifications from SNIPES SE.
SNIPES SE uses personal data you provide to us, or that we obtain through our business relationship with you, to register you for marketing materials and to manage exclusive access.
We may also use your personal data to inform you about SNIPES SE products and offers, as well as for market research purposes, including the analysis and development of our products and customer relationships.
